India’s Antitrust Watchdog Moves to Advance Apple Case Against Delays

    Regulatory escalation

India’s competition regulator has issued a firm warning to Apple Inc, signalling that an antitrust case will advance unless the company promptly complies with investigatory demands. The Competition Commission of India has expressed frustration with repeated procedural delays in Apple’s responses to requests for information and objections tied to an ongoing probe into alleged dominance abuses on its App Store platform. A confidential regulatory order issued in late December criticised what it described as a pattern of delay that undermined procedural discipline and weakened confidence in a timely resolution.

Apple has challenged India’s proposed penalty framework in the Delhi High Court, arguing that fines calculated on global turnover could result in an excessive financial burden. The company sought to pause the antitrust proceedings until the court rules on how penalties should be assessed. Regulators rejected that request and set a firm deadline for Apple to respond directly to the substance of the investigation rather than relying on procedural appeals.

The investigation stems from complaints filed by Indian startups and international app developers, which escalated in 2022 as scrutiny of digital platform practices intensified. Regulators allege that Apple leveraged its control over app distribution and in-app payment systems to impose restrictive conditions on developers, limiting competition and raising costs in India’s rapidly expanding digital economy. Apple has denied the allegations and maintains that its marketplace policies are lawful and designed to protect users.

India’s competition authority has increasingly aligned its enforcement posture with global regulatory trends targeting dominant technology platforms. However, the regulator’s decision to impose strict deadlines signals a more assertive approach that prioritises enforcement momentum over prolonged legal uncertainty. Officials have indicated that court proceedings will not automatically stall regulatory action unless explicitly ordered.

    Antitrust enforcement intensifies

The case reflects broader tensions between national regulators and multinational technology firms operating across jurisdictions with divergent legal frameworks. India’s stance highlights the growing willingness of emerging markets to enforce competition law independently, even when facing resistance from some of the world’s largest technology companies.
